The Bolder Scena General Terms and Conditions and Privacy Rules (hereinafter: “General Terms and Conditions”) are deemed as the operating conditions and constitute a legal contract between the end user (hereinafter: “visitor”/ “climbers”) and the company BS Group, plezalni center, d.o.o., managing the Bolder Scena climbing gym (hereinafter: “BS”).
The General Terms and Conditions are always accessible at https://bolderscena.si/pogoji-poslovanja/. As they will be occasionally updated, the visitors should follow this website on a regular basis to keep track of the currently valid version of the General Terms and Conditions. BS will notify visitors of any significant changes made to the General Terms and Conditions via email before the updates take effect, which will allow them to review them, unless immediate changes are required by the legislation. The currently valid version of the General Terms and Conditions applies to all visitors continuing to visit BS.
Introductory provisions
1.
The General Terms and Conditions are an integral part of the contract concluded between the visitor of the Bolder Scena climbing gym and the company BS Group, plezalni center d. o. o., and are currently published at https://bolderscena.si/pogoji-poslovanja/.
2.
The contract from Item 1 hereunder is concluded with electronic validation of the registration form. In order to use visits or other BS services, visitors have to register in STUDIONAUT, an application used by BS for its operations.
3.
All relationships between the visitor and BS that are not subject to these General Terms and Conditions are regulated, in addition to the current legislation, by all rules and the pricelist of the climbing gym, available at www.bolderscena.si, in the application Studionaut and physically at the climbing gym (hereinafter: “the Rules”). In case of any discrepancy between the pricelists available on the website, in Studionaut or physically at the climbing gym, the Studionaut pricelist will prevail.

Any changes to the General Terms and Conditions and the Rules will be posted by BS regularly on the website www.bolderscena.si, while all essential changes will also be submitted to visitors by email.
First visit
5.
Before entering into a contract with BS, each visitor must properly evaluate their physicalabilities and, if needed, consult with their doctor about the appropriateness of the selected physical activity, choosing only those that fit, in terms of intensity or difficulty, their physical strength and stamina.
6.
Upon the first visit, the visitor must fill in the electronic registration form fully, by entering their valid information, and take a photo. This applies to all visits except a one-time independent visit.
Opening hours
7.
The climbing gym is open from Monday to Sunday from 9 a.m. to 11 p.m. Visitors must leave the BS premises (e.g. climbing hall, gym, Gibalnica, children's climbing wall – Brlog) 30 minutes before closing time, and the bar no later than 10 minutes after closing time. On work-free days, BS is closed or operates according to the opening hours announced
beforehand or as agreed. BS reserves the right to change the opening hours, which will be posted on the website at www.bolderscena.si.
8.
In the event of any measures taken by the Slovenian Government due to special circumstances (such as an epidemic), the opening hours and the conditions of using the purchased visits will be adjusted to these measures, of which visitors will be notified by BS regularly via the website www.bolderscena.si.
Payment for services
9.
All services offered by BS, such as independent visits, trainings, programs and other activities (hereinafter: “sessions”) are payable. The pricelist is displayed at the BS climbing gym and posted on the website www.bolderscena.si. In case of price changes, the price of the service posted in Studionaut, at https://www.studionaut.com/Booking/Pricelist, during the time of concluding the contract, will apply. The price of the session (hereinafter: “session price”) must be paid by the visitor in advance for the chosen workout program, upon concluding the contract, unless the pricelist states
otherwise. Reduced session prices are possible only based on a prior agreement with the BS management. BS does not reimburse the session price if the visitor does not attend the session.
10.
In cases when the BS climbing gym is closed due to force majeure or state measures, the remaining part of the already paid program is transferred to the time period after the force majeure or state measures have ended. If due to force majeure or state measures, BS is allowed to offer only limited services, the proportionate amount of the already paid sessions will be transferred to the time period after the measures have ended. During this time, all interested visitors will be offered, provided that the state measures allow, proportionately reduced services or services limited in accordance with the required measures, whereby the obligations of BS are deemed fulfilled.
Payment terms
11.
All passes, except those purchased by companies for their employees, can only be used by the person who purchased them and are not transferrable. All passes for independent visits are valid on both locations; this, however, does not apply to special offers or packages, for which the location where they can be used will be specified. Guided trainings and the climbing school are subject to payment terms posted at www.bolderscena.si.
Before entering the BS climbing hall, visitors must pay or use their purchased passes. After the payment, reimbursements are not possible. The pass validity period begins on the day it is purchased, i.e. the date recorded upon the purchase of the pass or package. The morning pass applies to visits made before 1 p.m., excluding weekends and holidays.
The monthly pass is valid for one (1) month from the purchase date and the yearly pass is valid for 12 months from the purchase date.
The validity of the gift card is 12 months from the purchase date. If the gift card is used to buy a package, the validity of the package is from the date the gift card is used to pay for the package.
Exceptional pass extensions are possible only in case of injuries or long-lasting illnesses based on the submitted medical document. Extensions due to a business or study absence are not possible. Long-term passes can be extended twice at the most and for a total of no longer than two (2) years.
Newcomer packages are intended for those who have visited BS only once or for whom only one visit was recorded on their profile, or for those who have attended the introductory training “Spoznaj balvansko plezanje”. The newcomer package can only be purchased once.
12.
Company passes are intended for company employees whose names are provided by the company representative or as otherwise agreed with the company. Extensions of company visits are not possible. The same applies to all club packages.
13. Guided trainings and the climbing school
Signing up is possible throughout the season if there are vacancies. The sign-up always ends with the end of the current period but can be extended before the next one. If a person signs up after the trainings have already started for the given period, the price is proportionately reduced.
Signing up for the given training period is confirmed with an issued order form sent to the email address of the person or their parent or legal guardian (“customer”) via Studionaut. The payment must be made within eight (8) days of receiving the order form or the order form rejected by sending an email to the contact email address published at www.bolderscena.si.
If the order form is not rejected, the customer must pay for the entire or, if so agreed, partial session price. The payment can be made in two instalments. The session price of the selected package must be paid in advance, unless the pricelist states otherwise. Reduced session prices are possible only upon a prior agreement with the BS management.
BS does not reimburse the session price if the visitor does not attend the trainings.
By signing up for the training period, the customer buys a number of sessions for this period, i.e. not absolute credits. The sign-up for all subsequent periods is automatic. If they want to sign out, this can be made solely via the contact email address published at www.bolderscena.si. The credit number for the given period depends on the number of the selected days within the period.
In case of a longer absence due to medical reasons, please contact the email address published at www.bolderscena.si.
If customers cancel their sign-up for the climbing school, they are reimbursed for all full months until the end of the period. The customer can sign out of an individual session in Studionaut up to four hours before the beginning of the session. By signing out, they receive a credit that can be used to attend another training within the current period or, by sending an email to the contact email address published at www.bolderscena.si, exchange it for an independent visit after the paid training period. The exchange for an independent visit is possible up to 14 days at the latest after the training period ends. The exchanged independent visits cannot be transferred to another person.
If less than seven children and less than six adults are signed up for the entire training period, the training is cancelled.
Single trainings within the training period can be cancelled, at the discretion of BS, if three or less people sign up for the training. In this case, the customers will be notified of the cancellation by email no later than 6 hours before the beginning of the session.
During the school holidays (autumn, winter, New Year, 1 May) and the national holidays, the climbing school does not take place. The same applies to guided sessions; however, on holidays, customers can receive a credit for a free independent session if their training would otherwise be on that day. This is arranged at the reception and is only valid on that specific day.
14. Day care during the holidays
Day care payment must be made no later than 14 days before the beginning of the day care program.
The program is implemented if at least five children are signed up. If less than five children are signed up for the specific time period, customers will be notified by email in a timely manner and the holiday day care will be cancelled.
If the customer cancels the holiday day care more than 10 days before the beginning of the program, BS will keep 10% of the payment. If the customer cancels the holiday day care 3 to 10 days before the beginning of the program, BS will keep 30% of the payment. If the customer cancels the holiday day care less than two (2) working days before the beginning of the program, BS does not reimburse the payment.
Upon agreement, BS can issue a credit for 30% of the paid amount, which can be used for climbing sessions at the BS climbing gym within six (6) months after the credit is issued.
If the customer cancels the holiday day care due to medical reasons, the customer must send an email to the contact email address published at www.bolderscena.si, including the medical certificate. BS keeps 30% of the paid amount regardless of when the day care was cancelled, while the remaining amount is returned to the customer. This also applies to a cancellation right before the beginning of the program. If the holiday day care is cancelled by BS, the entire amount is reimbursed to the customer.
15. Birthday celebrations
Cancellations of birthday celebrations must be submitted no later than five working days before the celebration to the contact email address published at www.bolderscena.si. In case of a later cancellation, the customer will be charged for the whole amount.
16. Space rental
Space rental at BS can be arranged based on a prior agreement with BS, and the payment is also made as agreed. If the space at BS is rented by a natural or legal person, they are required to settle the payment.
Rules of conduct
17.
Upon BS’ request, the visitor must provide a personal document. The visitor is required to follow BS’ instructions as well as all notifications and rules from Item
3 hereunder. BS is allowed to remove from the BS premises any visitors violating (1) the General Terms and Conditions, (2) Rules and/or (3) BS staff’s instructions without payment reimbursement. If the violation occurs during organized activities outside BS, BS is entitled to request the visitor to leave these activities. In case of a subsequent violation by the same visitor, they can be prohibited to enter the BS premises or attend organized activities outside BS, while the session package paid in advance is no longer valid.
The visitor is required to behave responsibly towards other BS visitors, their property and BS property. They should not disturb other visitors during climbing sessions.
The visitor is required to use water and other energy resources sparingly, and is required to recycle waste.
Smoking and using drugs is prohibited on the BS premises.
Drinking alcohol at BS is allowed only in the bar, but not before the climbing session or any other indoor or outdoor activity organized by BS.
Anyone under the influence of psychoactive and other intoxicating substances is not allowed to enter the climbing and other BS areas. Such persons can be prohibited from entering or can be removed from the BS premises by the BS staff or they can be prohibited to attend an organized activity outside the premises.
18.
The visitor is required to thoroughly warm up before the beginning of the session. There is a space for warming up before the session intended specifically for this purpose.
Entering the climbing and other BS areas is allowed only in clean footwear.
Bouldering and walking on the padded flooring is allowed only in climbing shoes or cleanfootwear.
Entering the warm-up gym and the Gibalnica or Brlog climbing areas during organized activities or other events is not allowed.
When moving across the padded surfaces, visitors have to pay attention to other climbers falling from the boulders.
Lying, sitting and other inappropriate lingering on the padded surfaces in the climbing hall is strictly prohibited. However, climbers are allowed to sit on the edges of the padded flooring if doing so does not put them or others in danger.
Climbing brushes must be returned immediately after use – in no case should they be left on the padded surfaces. The same applies to personal belongings, including drinks and food, which are not allowed on the padded surfaces.
19.
Visitors should choose only those boulders which suit their climbing knowledge, skills, capabilities and strength.
Climbing over the edge of the wall at BS poses a great risk of falling and is not allowed.
The padded flooring at BS is different from the usual padded surfaces in gyms. For this reason, visitors should gradually learn and practice safe falling from heights. Falling on the padded surface must be controlled to ensure (1) one’s own safety, (2) the safety of other people in the room (3) and, primarily, the safety of children when they are in the climbing hall or during the BS activities in nature.
BS recommends spotting other climbers in case of younger or less experienced climbers and in case of uncontrolled movement.
After the climbing session, visitors are required to return any workout accessories to their designated place.
About the dangers of climbing and exclusion of BS’ liability
20.
Climbing is a sport requiring (1) adequate level of physical strength and motor skills, (2) knowledge of safety rules for different types of climbing and (3) awareness that overexertion or incorrect workouts are detrimental to health, (4) awareness of the risk of injuries, from scratches, bruises and sprains to fractures and even death.
21.
Each visitor’s climbing sessions, trainings and workouts are on their own responsibility.
22.
Compensation for damages is regulated by the Obligations code on the reimbursement of damage. In relation to this, BS undertakes to ensure a safe climbing environment and safe climbing.
23.
BS shall not be liable for damage (injuries and other inconvenience) resulting from:
1. Improper behaviour (action or failure) by the visitor, their violation of the rules on safe climbing and acting on or under the wall (both indoor and outdoor), failure to comply with concrete BS instructions and warnings or an unfortunate coincidence experienced by the visitor during climbing or training;
2. The actions of other BS visitors or third persons;
3. Events that could not have been foreseen, avoided or prevented;
4. Inappropriateness of the equipment or defects in the climbing equipment not owned
by BS.
In case of either their own or other climber’s injury, the climber must immediately notify the BS staff and follow their instructions.
Care for personal belongings
24.
Storing equipment and personal belongings is allowed only in locked lockers in locker rooms or on the shelves facing the climbing hall. Leaving them anywhere else, especially in the climbing hall, on the padded surfaces or in the access areas, is prohibited.
After leaving the climbing gym, visitors are required to completely empty their lockers and take all their things with them. BS and its staff are not responsible for any lost personal belongings. Lockers that remain locked after closing hours will be opened by BS and their content will be moved to lost and found.
As it often happens that visitors accidentally take other people’s personal belongings, thinking they are their own, it is recommended that the equipment, especially backpacks, climbing shoes and chalk bags, have the visitor’s name on them.
Visitors should not bring any valuables to the BS premises or organized activities outside the BS premises.
BS is not responsible for any forgotten, lost or stolen personal belongings. Personal belongings left in the lockers after closing time, including the locks, can be removed by BS at its discretion.
Taking pictures and recording
25.
Photographs taken at the reception for the purpose of customer identification will not be used for other purposes. Each visitor consents to BS’ photographing and recording visitors’ activities at BS or other locations, including outdoors, and public events organized or co-organized by BS for promotional and other commercial purposes connected to BS services. At the same time, visitors consent to these photographs and videos being published at the BS premises regardless of whether the visitor is clearly visible or not.
With respect to public media (internet and other media), visitors allow the publication of only those photographs and videos where they are not clearly visible. Any public publication of the recorded content where visitors can be clearly visible are allowed only with the visitor’s prior consent given to BS.
Personal data protection and processing for the purposes of offering services
26.
For the purposes of executing the contract, BS collects and processes the following personal information of each visitor: (1) name and last name, (2) date of birth, (3) gender, (4) address, (5) e-mail, (6) telephone number and (7) the visitor’s photo. If the visitor is a minor, BS will collect, in addition to the above information, also the following: (8) the parent’s or legal guardian’s name and last name, (9) email and (10) telephone number of the parent or legal guardian. The information about the guardian will continue to remain stored after the visitor reaches full age and can be removed if the guardian sends a written request to the contact email address published at www.bolderscena.si.
The visitor consents to BS using their e-mail address and telephone number to manage contacts and implement the contract with BS.
As the manager and processor of personal data, BS undertakes to respect privacy, using the visitor’s personal information exclusively for the purposes and to the extent necessary for the fulfilment of the contract and other agreements between the visitor and BS. For the purposes of company operations and visits analysis, BS is allowed to use the obtained visitor information in anonymized or aggregated form.
All personal information, entrusted by the visitor to BS directly or via the STUDIONAUT application, is managed and processed by BS or its authorized subjects.
BS undertakes to protect all personal information with due diligence and use it in compliance with the applicable legislation on personal data protection and with the company’s internal
acts. BS undertakes to not disclose any personal information to third persons without the visitor’s consent.
The gathered personal information will be kept until the cancellation of the visitor’s consent or as long as necessary to achieve the purpose for which this information is being processed or fulfil legal requirements.
The visitor can, at any time, cancel the consent or request insights, corrections, limitation of processing, deletion or transfer of their personal information or submit comments by sending an email to the contact e-mail address published at www.bolderscena.si. The cancellation has no effect on the data processing performed until the cancellation.
BS undertakes to implement all required technical and organizational protective measures to ensure personal data protection. In case of a violation of personal data protection, BS undertakes to execute all required measures (technical, organizational) to protect visitors’ rights and interests, inform them of the violation and notify the competent body in the Republic of Slovenia.
Minors
27.
Minors, i.e. persons under 18 years of age, are allowed to attend the sessions under the conditions stipulated in Item 1 of these General Terms and Conditions if the registration form (available at www.bolderscena.si) or a special statement is filled out and signed by their parents or legal guardians (legal representatives).
All other provisions hereunder are reasonably used also in case of minors. Their responsibility for any damage is assessed in accordance with the applicable legislation.
Children under 14 years
28.
Children under 8 years can climb at BS in the children’s climbing/playing gym (Brlog) and in the climbing gym intended for young adults. Their presence in these gyms is allowed during the children’s sessions within the framework of organized day care or independent sessions.
Children are allowed in the children’s gym (Brlog) only when accompanied and watched by an adult.
Children under 8 years are not allowed to enter the main climbing area, except when accompanied by the BS staff during the children’s sessions or other organized events.
Children between ages 8 and 14 are allowed to climb in the main climbing hall only when accompanied by an adult.
Application Studionaut
29.
For the purposes of executing the contract, BS uses the application owned by the company STUDIONAUT, d. o. o. (hereinafter: “application manager”). BS visitors can download the mobile application Studionaut to their smartphone or tablet using the online or mobile app store. The Studionaut application can also be accessed via the webpage www.studionaut.com or www.studionaut.eu.
Final provisions
30.
The General Terms and Conditions take effect on the day they are published on the webpage at https://bolderscena.si/pogoji- poslovanja/ or in the Studionaut application. In cases of doubt, the most recent version will prevail.
